Terms of Service

1. Agreement & Eligibility

These Terms of Service ("Terms") govern your use of the Vellune mobile application ("App") operated by Pack6 LLC ("we," "us," or "our"), a company registered in Jamaica. By downloading, installing, or using the App, you agree to be bound by these Terms.

You must be at least 13 years old to use Vellune. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Service Description

Vellune is an iOS application that allows paired users to write handwritten love notes and place them in augmented reality (AR) within shared physical spaces. The App enables features including handwritten note creation, AR note placement, scheduled delivery, a shared memory archive, and a private map of placed notes.

3. Accounts & Pairing

To use Vellune, you must create an account and pair with one other person via invitation. You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate profile information.

4. Subscriptions & Payments

Vellune offers a free tier with limited features and optional paid subscriptions that unlock additional functionality. Subscriptions are billed through Apple's App Store and are subject to Apple's payment terms. You may manage or cancel your subscription at any time through your device's Settings. Refunds are handled by Apple in accordance with their refund policies.

5. User Content

You retain ownership of all content you create within Vellune, including handwritten notes and associated AR placements ("User Content"). By using the App, you grant Pack6 LLC a worldwide, non-exclusive, royalty-free license to store, process, and transmit your User Content solely for the purpose of operating and providing the App's services to you and your paired partner.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful or harassing purpose
• Create fake accounts or impersonate another person
• Attempt to reverse-engineer, modify, or interfere with the App's functionality
• Transmit harmful, offensive, or threatening content
• Use the App to distribute spam or unsolicited communications
• Exploit bugs or vulnerabilities rather than reporting them

7. AR & Device Permissions

Vellune uses Apple's ARKit framework to place notes in augmented reality. Camera access is required for AR note placement and discovery. AR spatial data (anchor positions) is stored to allow notes to persist in placed locations. You may revoke camera access at any time via your device's Settings, though this will limit core App functionality.

8. Intellectual Property

The App's design, code, branding, and all non-user content are the intellectual property of Pack6 LLC. You are granted a limited, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Content Moderation

While Vellune is designed as a private experience between paired users, we reserve the right to review reported content and take action (including account suspension or termination) if content violates these Terms or applicable law.

10. Termination

You may delete your account at any time through the App. We may suspend or terminate your account if you violate these Terms. Upon termination, your User Content stored on our servers will be deleted.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AR placement will be perfectly accurate in all environments.

12. Limitation of Liability

To the maximum extent permitted by law, Pack6 LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amounts you have paid to us in the 12 months preceding the claim.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the revised Terms.
